Reclaiming Liberty from the Court (November 3, 2015)
Many Americans don’t realize the close connection between the Supreme Court’s rulings this summer on Obamacare and same-sex “marriage.” In the Obamacare ruling, the Court acted like a legislative body to add words to the Obamacare statute, saying the words “state exchanges” in the statute should include the words “or federal exchanges.” On marriage, the Court acted like a legislative body by telling states they had to substitute the words “two parties” for the statutory words “man and a woman.”
Courts cannot make law, but that is what our Supreme Court is doing—and Congress and our state legislatures need to stop them. Otherwise unelected judges will continue to overrule the will of the people.
