FACT was granted the court’s permission to file a brief supporting Tennessee’s sovereign right to define marriage in a lawsuit that tests Tennessee’s constitutional definition of marriage. FACT’s “friend of the court” or Amicus Brief has been officially filed with the Federal District Court for Middle Tennessee and is being considered by Judge Aleta A. Trauger, who was assigned the case. FACT in partnership with the Alliance Defending Freedom submitted the brief, asking the court to focus on the issue of state’s rights — the rights of the states to determine their own policies regarding marriage and family.
Four same-sex couples filed a lawsuit in U.S. District Court last October 2013 to force the state to recognize their marriages that were performed in other states.
